AI Tutoring and HB 1416: A Texas Teacher's Guide for the 2026-27 School Year
HB 1416 made AI literacy a Texas mandate. STAAR redesign is live. Your principal is asking about AI. Here is a Texas-specific guide to AI tutoring that aligns with TEA, respects SBEC, and helps your kids pass STAAR.
What HB 1416 actually says
If you've tried to read HB 1416 yourself, you've probably hit a wall of legislative language. Here's the plain-English version of what it does:
The four things every Texas district must do by 2026-27

Adopt a written AI literacy policy. Districts must have a board-approved policy on student and staff use of AI. TEA has not (yet) mandated what must be in the policy, but expects districts to address: prohibited uses (e.g., impersonation, completing student work, generating false content), permitted uses (e.g., tutoring, accessibility), parent notification, data privacy, professional development.

Integrate AI literacy into existing instruction. This is not a new required course. TEA expects districts to integrate AI concepts (what AI is, how it works, its limits, ethical use, prompt literacy) into existing subjects — library skills, computer science, CTE, social studies ethics units, even English language arts media literacy units.

Provide teacher professional development on AI. Districts must train teachers on how to use AI, how to teach about AI, and how to recognize AI-generated content in student work. The bill does not specify hours, but TEA recommendations lean toward 6-12 hours annually.

Notify parents of AI use. Districts must have a process for informing parents when their child uses AI tools and what data is collected. This is essentially a COPPA / FERPA extension.
What HB 1416 does NOT do
- It does NOT ban AI in schools
- It does NOT mandate that teachers grade AI-generated content
- It does NOT require a specific vendor or platform
- It does NOT prohibit adaptive tutoring tools
- It does NOT fund any of this — that's been left to districts and the legislature
So when you read breathless news coverage about "Texas bans AI in schools" or "Texas mandates AI tutors," neither is true. HB 1416 is a framework bill, not a product bill.
What TEA has recommended so far
TEA (Texas Education Agency) has released preliminary guidance on HB 1416 implementation. Key recommendations:
1. Districts should treat AI as a tool, not a curriculum
TEA's draft guidance (Sept 2025) says AI literacy should be taught "in context" of existing instruction. Districts should not create standalone "AI Literacy" courses unless they have a robust CTE pathway that justifies it. The agency expects the integration model: lesson here, lesson there, embedded across subjects.
What this means for you: You probably won't get a new preps period for AI. AI becomes part of how you teach your existing subject, not a new subject you teach.
2. Districts should align AI tools to TEKS
TEA's guidance recommends that districts align AI tools to existing TEKS standards wherever possible. AI tutoring tools should map to specific TEKS, not generic "math" or "reading" buckets.
What this means for you: When evaluating AI tutoring tools, ask which TEKS they cover. The answer should be specific — "CCRS Level 1, STAAR-reported category 1 (Numeric Representations), TEKS A.1.A" — not vague. If a vendor can't name TEKS codes, they haven't done the curriculum work.
3. Districts should follow SBEC ethics for teacher AI use
The State Board for Educator Certification (SBEC) hasn't yet updated the Educator Code of Ethics for AI specifically, but TEA guidance points to the existing standard: an educator shall not "solicit, engage in, or facilitate commercial transactions for personal gain" with students — by extension, tools used with students should serve the student's educational interest, not the educator's or vendor's.
What this means for you: If you recommend an AI tool to a parent or use one with your students, the recommendation must be defensible on student-educational-interest grounds. If you can't defend it, don't use it.
4. Districts should default to FERPA + COPPA + Texas DPS security standards
TEA's guidance is clear on this: any AI tool used with K-12 students must be FERPA-compliant (federal), COPPA-compliant (federal, under-13), and follow Texas-specific data security standards (Texas Government Code Chapter 2054, "Texas Cybersecurity Act"). Districts should require signed Data Privacy Agreements (DPAs) before any AI tool touches student data.
What this means for you: If your district hasn't signed a DPA with an AI vendor, the tool is not approved. Period. You can't be the fall person for approving it on your own.
How AI tutoring fits into STAAR prep (and the red lines)
STAAR redesign has been live since spring 2023. The new design is cross-curricular, claims-based, and (in math) uses problem-solving in context. Adaptive AI tutoring maps well to this — provided the AI is built for K-12, not just a general-purpose chatbot.
Where AI tutoring helps STAAR prep
Sub-skill gap identification. STAAR math is built on a stack of sub-skills (numeracy, proportional reasoning, problem representation, etc.). The new claims-based scoring rewards proficiency across multiple sub-skill areas. An AI tutor that surfaces sub-skill gaps is more useful than a test-prep book that just covers the test in order.
Adaptive practice aligned to TEKS. Each TEKS standard has specific readiness and supporting standards. A good AI tutor targets the readiness standards first, then layers in supporting standards. This matches how STAAR is built.
Immediate feedback loops. STAAR-style questions often have multiple-step reasoning. AI tutoring can walk a student through their reasoning on a missed problem in real time — faster than waiting for class feedback next day.
English language learner support. ELL students struggle disproportionately with STAAR reading. AI tutoring that adapts language complexity without lowering content is a force multiplier for these students.
Where to draw red lines
Don't use general-purpose chatbots for STAAR prep. ChatGPT, Claude, Gemini, etc., are not K-12 tools. They will give answers. They will hallucinate on math. They will occasionally produce inappropriate content. They are also not FERPA-compliant for student use, period.
Don't replace real STAAR-released practice with AI practice. TEA provides STAAR-released test forms. Use them. AI practice is a complement to released forms, not a replacement.
Don't use AI to grade student STAAR practice essays. STAAR essays are graded by humans. AI grading of practice essays is fine for self-monitoring, but the official score must be human.
Don't let AI make decisions about STAAR readiness for individual students. Teachers make placement decisions. AI informs teachers.
These red lines are defensible to TEA, SBEC, and parents. Crossing them is not.
A 5-step plan for Texas teachers using AI tutoring
If you're a Texas teacher and your district has approved an AI tutoring tool, here's how to use it inside the HB 1416 + STAAR framework:
Step 1: Make sure there's a signed DPA on file
Ask your principal or EdTech director: "Is there a signed Data Privacy Agreement on file with this vendor? Can I see it?" If the answer is no or "we're working on it," don't use the tool with students yet.
Step 2. Align your AI use to specific TEKS
Don't say "we use AI for math." Say "we use AI tutoring for STAAR-reported category 1 readiness standards in TEKS A.1.A through A.4.B." Specificity is defensibility.
Step 3. Document the AI use in your lesson plans
Include AI tutoring in your weekly lesson plans the same way you include any other resource: which TEKS, which students, what data you're collecting, how you're adjusting instruction. This protects you and your district if TEA audits.
Step 4. Notify parents per district policy
If your district has a parent notification process for AI tools, follow it. If they don't, push your principal to adopt one. Either way, document the notification.
Step 5. Use AI data to inform your STAAR prep cycle
At the AI tutor dashboard, look at sub-skill data weekly. Regroup students based on the data. Use released STAAR forms at the start of each unit as a pre-assessment, and at the end as a post-assessment. Cross-reference AI data with STAAR data to triangulate readiness.
What to evaluate in an AI tutor for Texas classrooms
When you demo AI tutoring tools, ask these Texas-specific questions:
- "Which TEKS does your tool cover?" If the answer is vague, walk away.
- "Is there a signed DPA on file with Texas districts?" If they can't name any, be cautious.
- "What does your data residency look like? US-only? Texas-based?" Texas has specific data security expectations.
- "How do you handle STAAR-released question types?" A good vendor will demo with STAAR format, not generic math.
- "Can teachers see sub-skill data per TEKS, not just an overall score?" If they can't, walk away.
- "Is your tool FERPA + COPPA + Texas DPS Chapter 2054 compliant?" If they don't know what Chapter 2054 is, they haven't done the Texas work.
- "Can a student bypass the tutoring and get the answer?" A good vendor will demo the failure mode.
A vendor who can answer all 7 in writing has done the Texas work. A vendor who can't is selling you a generic math chatbot.
